Averages and Maximums Clause Examples

The "Averages and Maximums" clause defines how certain values, such as quantities, prices, or performance metrics, are to be calculated or limited within a contract. It typically specifies whether figures should be determined based on average values over a set period or capped at a maximum threshold, depending on the context. For example, it may state that the average monthly usage will be used for billing, or that no single delivery can exceed a specified maximum amount. This clause ensures fairness and predictability by preventing extreme fluctuations or outliers from unduly affecting obligations or calculations under the agreement.
