As of the Effective Date, the Revolving Loans and the other Lender Obligations constitute the only Debt of the City or the City, for and on behalf of its Department of Aviation, that is secured by a Lien on the Net Revenues other than the Senior Bonds, the Senior Obligations, the Subordinate Bonds, and other Subordinate Obligations issued or incurred prior to the Effective Date.
Under the terms of the General Bond Ordinance and the General Subordinate Bond Ordinance, the Net Revenues cannot secure any Debt of the City (including Debt for and on behalf of its Department of Aviation), other than as provided in or permitted by the General Bond Ordinance, the General Subordinate Bond Ordinance and the General Junior ▇▇▇▇ ▇▇▇▇ Ordinance.
The City, for and on behalf of its Department of Aviation, shall not have failed to pay principal of or interest as and when due on any of its indebtedness payable from the Net Revenues and the Funds.
The Net Revenues cannot be used to pay any obligations of the City (including Debt for and on behalf of its Department of Aviation) other than the foregoing described Debt, Operation and Maintenance Expenses and any other lawful purposes.
Notwithstanding any other provision of this Agreement or any other Related Document to the contrary, the Lender Obligations are special obligations of the City, for and on behalf of its Department of Aviation, payable solely from the Net Revenues and Pledged Funds of the Airport System subordinate to the Senior Bonds and the Senior Obligations and on parity with all outstanding Subordinate Bonds and other outstanding Subordinate Obligations.
