Seller 401(k) Plan definition

Seller 401(k) Plan shall have the meaning set forth in Section 6.01(i).

Seller 401(k) Plan has the meaning specified in Section 7.02(e).

Seller 401(k) Plan has the meaning set forth in Section 4.5(j).

This Section 4.4 prohibits, without limitation, the issuance or sale by Seller of any Seller Stock to the Seller 401(k) Plan.
Prior to taking any such action, Seller and Seller Sub shall provide Buyer with a copy of such resolutions or consent in connection with such Seller 401(k) Plan termination, and shall consider any comments provided by Buyer in good faith.

Seller 401(k) Plan has the meaning set forth in Section 9.4(h) hereof.

Seller 401(k) Plan means the Xxxxxxx Retirement and Savings Plan.

Seller 401(k) Plan has the meaning given to such term in Section 6.01(g).

Seller 401(k) Plan means an Employee Plan that is a 401(k) Plan.

Seller 401(k) Plan as defined in Section 7.5(p)(i).

Seller 401(k) Plan is defined in Section 5.4(c).
